What is Probate?
“Probate” is a term commonly used when talking about applying for the right to deal with a deceased person's affairs (called 'administering the estate'). In practice, different terms are used, depending on whether or not the deceased person left a will.
If the person who died left a will
In this case one or more executors may be named in the will to deal with the persons affairs after their death. The executor has to apply for a grant of “probate” from the court known as the probate registry.
We regularly work with the named executors of bereaved families in the Solihull area with the Probate process where a Will has been left.

If the person who died didn’t leave a will
If someone dies without leaving a will, they are said to have died “intestate”. A close relative can apply to the probate registry for a grant of representation. When this happens dealing with their estate can be very complicated. It can also take a long time - months or even years.
If someone close to you has died without leaving a Will then it is sensible to seek professional help, so please contact Think Wills & Probate in Knowle as soon as possible.
